1.0 BUSINESS SERVICES AND PRODUCTS
Armidia.com owns and operates the site found at www.automart.co.uk.
Armidia.com reserves the right to cancel or suspend a customer's access to
any or all services provided by Armidia.com if it is decided by Armidia.com
that the account and/or services purchased by a customer have been
inappropriately used. Armidia.com reserves the right to cancel or suspend
contracts at any time and to remove
adverts immediately. Under such circumstances Armidia.com will not be liable
for any costs, however incurred, for the customer to transfer their advert
or goods to a third party provider.
1.1 VIEWING ADVERTS
Users of the site found at www.automart.co.uk have access to adverts placed
by dealers and private advertisers. Armidia.com does not guarantee, in any
form, the accuracy of the information found on these pages. You are advised
to check all information with the seller before making a purchase.
2.0 ADVERT PLACEMENT AND DURATION
Adverts placed will be dealt with as quickly as possible and advert details
passed to the relevant third party sites if required. Armidia.com cannot be
held responsible for the non-placement of adverts at third party sites or
for any errors made by third party sites with regard to your advert. Third
party sites display adverts for varying durations. Armidia.com will not
re-submit adverts to third party sites once the initial advert duration has
passed. By placing an advert you are consenting to your personal information
being placed on www.automart.co.uk and other third party sites where your
information can be viewed by anyone. By placing an advert you are granting
us license to use and distribute the advert and your personal information in
the original and revised format to other websites and media associated with
www.automart.co.uk. Your advert must comply with the British Code of
Advertising Standards and be wholly honest, decent, and legal. In all
circumstances you agree to indemnify us as per paragraph 8.0
In all cases adverts will be removed from the automart.co.uk database after a period of 3 months unless you contact us otherwise. This enables us to maintain a high quality database.
2.1 ADVERT REMOVAL
If you wish your advert to be removed from the pages held at automart.co.uk
i.e. on our own servers, then you can do so using your account logon details
or by sending an e-mail to remove@automart.co.uk advising us to remove your
advert and quoting your advert number. We cannot guarantee that adverts held
on third party sites will be removed.
We will remove all adverts as per the conditions set out in 2.0 above.
2.2 PHOTO ADVERTS AND PREMIUM ADVERTS
You may include photos with Photo adverts, Premium adverts and Platinum adverts according to the limitations placed with each advert. You are responsible for taking and uploading your own photos. Automart.co.uk do not take photos for inclusion with adverts.
Premium adverts and Platnium adverts may not be displayed as a Featured Car until a photo has been uploaded in order to maintain the integrity of the website.
Platinum adverts have access to an account manager. You must make contact with the team at sales@automart.co.uk if you wish to access this facility.
2.3 REGISTRATION
In order to place an advert you need to register. A registration form is available here. Once you register you will receive a confirmation e-mail. The special offer e-mails will be sent out at the rate of approximately 3 or 4 per year. You may remove yourself from the database by sending an e-mail to remove@automart.co.uk
3.0 ORDER CANCELLATION
You may request cancellation of your advert by e-mailing
sales@automart.co.uk. Once an order has been placed, you have 7 working days in which a refund can be claimed in line with the rules set out under the Consumer Protection Distance Selling Regulations 2005 if:
- the advert has not been approved and the service has not commenced.
If the advert has been approved and the service has commenced then a refund can not be claimed. 4.0 ORDER ERRORS
If an order has errors, please send an email to sales@automart.co.uk making
any necessary corrections. If your order has any errors and Armidia.com is
not notified immediately following your original submission of an order,
then we cannot be held responsible for any errors that may occur. If a third
party site contains an advert error then we will endeavour to amend this,
however we cannot be held responsible for any actions resulting from
incorrect information displayed on any third party site.
5.0 BACK-UP POLICY
Armidia.com periodically backs up its servers. However, Armidia.com cannot
be held responsible, in any way, if information is lost. In any case where
Armidia.com cannot provide a copy of any information which you held on our
servers, no liability, costs or claims will be made against Armidia.com.
Please refer to INDEMNIFICATION below.
6.0 PAYMENT POLICIES
(Important, so please read carefully!) All payments should be made in UK
Sterling and any cheques made payable to 'armidia.com'. Payments for adverts
will be taken using our banks secure server which operates 128bit digital
encryption. Where an advert has been placed and the payment not completed,
the advert will not be placed.
7.0 CANCELLATION
Armidia.com reserves the right to cancel or suspend services at any time.
All fees paid in advance of cancellation will be prorated and paid by
Armidia.com if Armidia.com institutes its right of cancellation. If
cancellation is caused by customer's violation of any of the policies, terms
and conditions set out on these pages, then no refund will be due. Any
payments due to be made by Armidia.com will be made onto the credit card to
which initial payment was made or by company cheque at Armidia.com's
discretion.
8.0 INDEMNIFICATION
All customers agree that they shall defend, indemnify, save and hold
Armidia.com harmless from any and all demands, liabilities, losses, costs
and claims, including reasonable attorney's fees asserted against
Armidia.com, its agents, its customers, officers and employees, that may
arise or result from any service provided or performed or agreed to be
performed or any product sold by a customer, his/her agents, employees or
assigns. All customers agree to defend, indemnify and hold harmless
Armidia.com against liabilities arising out of; (1) any injury to person or
property caused by any products sold or otherwise distributed in connection
with armidia.com servers; (2) any material supplied by a customer infringing
or allegedly infringing on the proprietary rights of a third party; (3)
copyright infringement (4) any defective products sold to customers from
Armidia.com servers and (5) any advert placed on Armidia.com servers via
www.automart.co.uk. or on any third party sites via www.automart.co.uk
9.0 DISCLAIMER
Armidia.com will not be held responsible for any damages your business may
suffer. Armidia.com makes no warranties of any kind, expressed or implied
for services provided. Armidia.com disclaims any warranty or merchantability
or fitness for a particular purpose. The includes loss of data resulting
from delays, non-deliveries, wrong delivery, and any and all service
interruptions caused by armidia.com and its employees. Armidia.com reserves
the right to revise its policies at any time.
